ICE Operations Restricted: Agents Barred from Knocking on Doors in Los Angeles

Ben Bergquam from Real America's Voice reported live from Los Angeles, embedding with Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO). The focus of their operation was to observe agents targeting high-priority individuals, including convicted rapists and child molesters.

Bergquam emphasized the importance of documenting these operations, stating, "Going to be embedding with ICE in Los Angeles today. So, come along with us."

An ICE agent explained that ongoing litigation in the Los Angeles Area of Responsibility (AOR) prevents them from conducting targeted enforcement operations on private premises. This means agents cannot physically approach a house and knock on the door to execute administrative warrants.

The agent clarified, "So, present ongoing litigation in the Los Angeles AOR does not permit us to conduct targeted enforcement operations on the premises. Meaning, we cannot physically go up to a house and knock on the door." Consequently, enforcement actions must take place in public spaces or at the curb, significantly impacting their operational tactics.

The ICE agent clarified that the restriction on approaching homes applies specifically to administrative warrants, not criminal ones. This distinction is crucial, as criminal warrants still permit agents to breach properties if necessary.

The agent stated, "And that's on administrative warrants. So, on felony warrants you can still go and breach," indicating that the policy specifically hinders the execution of administrative warrants.

The restrictive litigation, commonly known as the Kelly litigation, began around 2022. This legal challenge has a broad scope, covering the entire Los Angeles field office jurisdiction.

The agent noted, "Well, litigation commenced in 2022 if I'm not mistaken. So, it's been some time." The litigation stemmed from claims of improper identification and alleged encroachment on private property during enforcement actions. The restrictions extend to areas as far north as San Luis Obispo, encompassing a vast geographical region.

ICE agents expressed significant safety concerns for communities due to sanctuary policies that often lead to the release of offenders back into neighborhoods. The agent cited an example of a registered sex offender living with a minor, highlighting the risks.

The agent explained, "A lot of the individuals that are released back in the communities because of these sanctuary policies, unfortunately, the individuals that they may go back and reside with are unaware of the crimes they have committed." This situation is further complicated by the current legal restrictions, which force agents to wait for suspects to exit their homes because they are unable to approach the residences directly.

The Kelly litigation significantly limits daily ICE operations by forcing agents to rely heavily on surveillance rather than direct engagement. This often means agents must expend considerable resources and time waiting in public spaces for targets to emerge from their homes.

The agent elaborated, "It's actually called It's referred to the Kelly litigation. It stemmed from our encounter with an individual a couple years back." This operational shift impacts efficiency and resource allocation, as agents are unable to act proactively at residences.
