H-1B Visa Mills Exploited for Corporate Gain

The Department of Labor is prioritizing the crackdown on the exploitation of foreign labor visas, which were originally established to assist American companies in securing necessary workforces. However, these protocols and processing systems have been manipulated, now harming American workers rather than supporting domestic businesses. The current administration has adopted a zero-tolerance policy towards fraudulent practices within these visa programs.

Anthony D’Esposito, DOL Inspector General, stated, "the department is is working hard. Obviously, as you mentioned, uh we're dealing with this foreign labor visas. The fact is is that many of these protocols and processing were put in place to help American companies and the America and and make sure that uh they can move forward with uh with the correct workforce and they've been extorted and exploited and now it's only hurting the American worker."

Visa exploitation is increasingly impacting American college graduates, who face significant hurdles in securing entry-level positions within their fields of study after years of education. The problem extends beyond the traditional 'body shop' tech sector, now encompassing a wider range of industries.

Abuse of foreign labor visas is evident in fields like the medical industry and other professional sectors, indicating a broadening scope of exploitation that displaces American workers. The Inspector General noted the severe implications for the educational investment made by families.

Anthony D’Esposito remarked, "The idea that we're sending our children, grandchildren, nieces and nephews to colleges and universities and then when they graduate, uh, they're having trouble finding jobs in what they just studied for four or, you know, more years, uh, because those jobs are being taken by by foreigners and and those that are again exploiting and extorting uh, the foreign labor visas. That's a real problem. And it's not just in the tech se sector."

Companies are significantly reducing their labor costs by employing foreign workers on visas, who historically earn 35% to 40% less than their American counterparts. This substantial wage differential creates a powerful financial incentive for corporations to favor visa programs over hiring domestic talent.

These considerable savings, multiplied across thousands of H-1B visa holders, translate into massive profits for companies, encouraging large-scale reliance on these programs. Whistleblowers play a crucial role in exposing these internal business practices that exploit the visa system for economic gain.

According to Anthony D’Esposito, "those that are working on foreign visas historically are making between 35 and 40% less than an American worker. So, if you own a company and you have a couple of thousand uh H-1B visas and you're saving 40% per person, that's a lot of money at the end of the year that's going into your pocket."

An industrial park featuring 30 office units was found with all offices closed and lights off, indicating no operational activity.

Despite the apparent emptiness, over 500 H-1B applications were approved and linked to this specific facility, underscoring the scale of the fraudulent activity. This discovery highlights the deceptive practices employed to exploit the visa system, creating a facade of legitimate employment.

The Department of Labor has taken decisive action by suspending H-1B applications for prominent companies Cognizant and Cloudera due to documented visa violations. These firms are frequently cited as key violators in ongoing investigations into visa abuse.

Acting Secretary Keith Serling is actively collaborating on enforcement efforts to address these violations, signaling a robust governmental stance against fraudulent practices. The DOL anticipates further suspensions and continued investigations to dismantle the networks exploiting foreign labor visas.

Anthony D’Esposito stated, "We've recently suspended. I'm working side by side with acting secretary Keith Serling. We suspended uh H1B applications for uh both Cognizant and Cloudera. They are two of the companies that you hear often who are violating H1Bs. And we're going to continue again to peel back that onion."
