The President's Constitutional Authority Over the Justice Department
Mike Davis, from the Article III Project, elaborated on the President's role as chief executive, commander-in-chief, and chief law enforcement officer under Article II of the Constitution. This framework, according to Davis, establishes a direct chain of command from federal prosecutors and agents to the President.
Davis explained that every federal prosecutor and agent reports to the Deputy Attorney General, who then reports to the Attorney General, and ultimately to the President, who is elected by all Americans. This structure, he asserted, underscores the President's direct authority over the Justice Department, challenging claims of its independence.
