Lucy Letby: Hospital Failures Led to Three Infant Deaths

The Thirlwall Inquiry into Lucy Letby's actions revealed a significant governance gap between the Countess of Chester Hospital's leadership and its clinicians, alongside a fundamental failure to grasp safeguarding principles. Errors by nurses, doctors, and managers at the time of the events were identified in the report, which will be further detailed later. There was a complete breakdown at all levels to activate safeguarding procedures, despite initial investigations into clinical or other explanations for infant deaths and collapses.

Safeguarding actions were not taken because senior nurses and managers consistently rejected the possibility that consultants' concerns about Lucy Letby were justified. Following the death of Baby P in late June 2016, and despite Letby's removal from the neonatal unit, senior management significantly delayed contacting the police. Reviews conducted at the time failed to investigate whether deliberate harm had occurred, a limitation acknowledged by the Royal College of Pediatrics and Child Health.

A 70-page summary report provides an overview of the inquiry's findings, but a detailed understanding requires examining the full report. The inquiry explicitly states it is not re-investigating criminal convictions or Letby's guilt, given the Court of Appeal's dismissal of two applications for appeal, and it is not intended to second-guess or undermine those legal avenues.

It investigated why it took nearly a year after Baby P's death to contact the police. Secondly, the inquiry examined the roles of external organizations such as the Care Quality Commission, the Royal College of Pediatrics and Child Health, and NHS England in these events. Thirdly, it considered how similar instances of deliberate harm on neonatal units could be prevented.

The inquiry also considered improvements to manager accountability across the wider NHS and emphasized two crucial points concerning the families involved. First, the identities of babies named in the indictment, and their families, are protected by Crown Court orders. Everyone commenting on the events is urged to respect these protections. Secondly, nearly all parents provided evidence to the inquiry, which is fully available on its website, and commentators are asked to bear this evidence in mind to avoid making families 'collateral damage' in public debates about Letby's guilt.

The inquiry accurately reflected the information known at the time by the Countess of Chester Hospital about the babies' conditions and the parents' experiences. It acknowledged the profound joy of birth, followed by the shock of sudden collapse or death, and the enduring grief and sadness experienced by families. Many parents expressed palpable anger over the hospital's treatment, as they were deliberately kept uninformed for years about the serious concerns regarding their babies' safety. They were not told about internal reviews and only discovered in 2018 that collapses and deaths might have been caused by a nurse they had trusted.

The report identified several collapses and deaths that could have been prevented if critical information had been acted upon. Mother E, for instance, possessed vital information about Letby and would have described hearing her baby screaming with blood on his mouth, with Letby present, had she been asked. Her twin, Baby F, was poisoned with insulin, and immediate action on these insulin results would have necessitated police involvement. Suspicion following Baby I's death also failed to trigger appropriate responses, allowing collapses and deaths to continue. A crucial meeting in May 2016 neglected to consider safeguarding, leaving Letby on the ward when she should have been removed.

This measure would deter potential harm and reassure parents, though such monitoring was not standard at the time of the incidents. Additionally, by March 31, 2027, all neonatal units must meet new requirements for access control and insulin storage, as babies F and L were poisoned with insulin. The new NHS England guidance for insulin storage and testing must be made mandatory nationally.

Until biometric data controls access to insulin storage, each trust is advised to install CCTV cameras pointed at insulin storage units. NHS England's recent guidance on testing and reporting insulin and C-peptide results must be made mandatory and nationally applied to ensure clear understanding and action. By March 31, 2027, the DHSC NHS England must also develop a one-page protocol for managers to follow when concerns or suspicions about deliberate harm are raised, even if the person raising them is unsure. Good faith concerns must be acted upon immediately, prioritizing patient protection by potentially moving the suspected staff member.

Moving a suspected individual is likely the first step in safeguarding children and babies, which includes referring cases to local authority designated officers and potentially involving the police. The inquiry explicitly states that no manager should ever again claim ignorance of appropriate actions. Mandatory safeguarding training for all staff and board members is recommended, covering how to handle suspicions of deliberate harm, and this obligation should be integrated into all new contracts. This isn't a new obligation but aims to clarify and reinforce a long-standing duty.

Integrating the obligation to raise concerns into employment contracts is expected to clarify this duty and achieve a cultural shift within the NHS. This change would also alleviate the burden on "freedom to speak up" guardians. Additionally, the Department of Health and Social Care (DHSC) should seriously consider establishing a panel of independent experts, including clinicians, to investigate concerns of inadvertent or deliberate harm in cases involving children or vulnerable adults. This panel would report its findings to the trust and DHSC NHS England and serve as witnesses in any subsequent legal proceedings.

Ringfenced funding should be allocated for the expert panel's operations. The inquiry also addressed widespread ignorance regarding the applicability of Sudden Unexpected Death in Infancy and Childhood (SUDIC) guidelines, clarifying that they do apply and all trusts must be informed. The DHSC is currently reviewing and revising SUDIC guidelines with experts, a process long overdue due to a lack of funding, now remedied. New guidelines are expected by March 31, 2027.

SUDIC forms must be redesigned and shortened, focusing solely on essential information for recipients. Grieving parents should never again face a lack of support or complete ignorance; the national bereavement care pathway for neonatal death must be implemented across all trusts by August 31, 2027. The NHS's numerous IT problems, particularly the lack of interoperability between medical systems within and across hospitals, persist despite being known for decades, a situation Professor Sir David Spiegelhalter described as a disaster and an extraordinary failing for such a large employer. The time for resolving this is now.

The inquiry recommended board-level monitoring for all child and baby deaths, with a clear escalation route for concerning data trends or patterns to ensure no death goes unnoticed by hospital boards. Board members must receive training to understand, interpret, and discuss available data with clinicians. The severe and long-standing shortage of pediatric and perinatal pathologists is also addressed, with a directive for DHSC and NHS England to ensure 37 doctors are in training posts by June 2033. Until then, existing staff must be trained to review and interpret data, and external support should be sought when necessary.

This consistency is non-negotiable. Managers should also owe an individual duty of candor to patients, colleagues, and external agencies, to be included in their code of conduct, mirroring existing duties for nurses and doctors. Recommendations were also made to prevent the "revolving door" phenomenon in the NHS, where senior managers move between trusts without accountability, aiming for implementation by September 2027 and full statutory regulation by September 2032.

Recommendations were made to enhance the quality of Care Quality Commission (CQC) inspections of neonatal units, moving beyond "box-ticking" to effectively determine baby safety in hospitals. A rigorous, consistent review of CQC performance is suggested, to be conducted annually by the Health and Social Care Committee initially, then every three years once satisfied. Additionally, the Parliamentary and Health Service Ombudsman should improve services for "freedom to speak up" guardians. The report notes a significant number of accepted recommendations from past inquiries that have not yet been implemented.

For recommendations to be implemented promptly and ensure the safety of patients, a determined and energetic approach is essential. The inquiry recommends assigning responsibility for auditing the implementation of statutory inquiry recommendations into NHS bodies to the National Audit Office. This body is independent of both government and civil service, and its reports to Parliament through the Public Accounts Committee carry significant influence. Oversight by the National Audit Office is expected to focus minds on implementing the inquiry's recommendations, ensuring accountability and timely action.
