China Rejects 2016 South China Sea Ruling

Tensions between China and the Philippines in the South China Sea have intensified, with Beijing strongly rejecting Manila's claims over disputed maritime features. China once again declared that it does not recognize the landmark 2016 arbitration ruling. This latest escalation focuses on Mischief Reef and Subi Reef, known in the Philippines as Panganiban Reef and Zamora Reef, respectively. Both reefs are part of the broader Spratly Islands dispute, where China, the Philippines, and several other governments maintain overlapping territorial and maritime claims.

Chinese Foreign Ministry spokesperson Guo Yakun responded to recent Philippine statements regarding Mischief and Subi Reefs. Beijing maintains that the Spratly Islands, which China calls Nansha Qundao, are Chinese territory, and all Chinese construction and activities there fall within its sovereignty. Guo also questioned what Beijing described as inconsistencies in Manila's position concerning Subi Reef, calling its claim "absurd and random, making it totally untenable." This language marks another unusually direct attack on the Philippine government's legal position.

This diplomatic confrontation follows a Philippine Department of Foreign Affairs statement issued on September 11, reaffirming its sovereign rights and jurisdiction over Mischief Reef and Subi Reef. The Philippine statement describes both features as low-tide elevations, which are naturally formed areas of land above water at low tide but submerged at high tide. Their legal treatment under the United Nations Convention on the Law of the Sea (UNCLOS) differs significantly from naturally formed islands that remain above water at high tide.

A low-tide elevation is a naturally formed land area visible at low tide but covered by water at high tide, and its legal classification under UNCLOS varies significantly from permanent islands. The Philippine government asserts that Mischief Reef lies within 200 nautical miles of Philippine archipelagic baselines, placing it within the country's exclusive economic zone (EEZ) and continental shelf. This legal distinction is central to Manila's claims of sovereign rights.

China argues that the Spratly Islands belong to China, asserting the Philippines cannot use UNCLOS maritime jurisdiction to claim rights over what Beijing considers Chinese territory. China further maintains that its construction on these features is legitimate, viewing these activities as taking place on Chinese territory. Beijing also objected to the Philippines' Maritime Archipelagic Zones Act (Republic Act No. 1264), arguing that Manila is attempting to place Chinese-claimed islands, reefs, and waters within Philippine maritime zones.

Its analysis of Subi Reef was detailed due to its legal relationship with nearby high-tide features like Sandy Cay, which was relevant when considering territorial sea rules.

China has consistently rejected the tribunal's findings, arguing that the Philippines improperly initiated the arbitration, the tribunal lacked jurisdiction over core elements of the dispute, and the award is legally invalid. Beijing reiterated this position this month, calling the arbitration "political manipulation designed to secure what Beijing considers unlawful maritime gains." Chinese officials routinely describe the decision as illegal, null, and void.

The tribunal affirmed its jurisdiction over the claims it ultimately ruled on. This fundamental difference in legal interpretation explains why Manila and Beijing continue to describe the situation so differently. For the Philippines, the award is final and binding, forming the legal foundation for its maritime rights. China, conversely, maintains the arbitration should never have proceeded and cannot determine its rights in the South China Sea.

The current Philippine government under President Ferdinand Marcos Jr. has consistently relied on the 2016 arbitration as a central component of its South China Sea policy. In July, around the 10th anniversary of the award, Chinese officials once again stated that Beijing neither accepts nor recognizes it. In September, China's foreign ministry issued another detailed statement rejecting efforts by the Philippines and several other countries to reaffirm the award. This fundamental divide remains unresolved. China bases its position on long-standing sovereignty over South China Sea islands and associated maritime rights, while rejecting the arbitration. The Philippines, conversely, relies heavily on UNCLOS and the tribunal's findings, arguing that China's broader maritime claims cannot override Philippine rights within maritime zones recognized under the convention.

The latest dispute over Subi Reef adds another layer of complexity. Initial reports from the Philippines described both Mischief and Subi Reefs in terms of the country's exclusive economic zone and continental shelf. However, the formal Department of Foreign Affairs statement now distinguishes between them, placing Mischief Reef within the Philippine EEZ and continental shelf, while describing Subi Reef as a low-tide elevation within the territorial sea of Pag-asa Island and its features. Beijing has capitalized on this distinction.

Resolving this disagreement requires distinguishing three intertwined questions often conflated. First, who holds sovereignty over islands that remain above water at high tide? Second, what maritime zones can those features legally generate under UNCLOS? Third, what rights do coastal states possess in surrounding waters? The 2016 tribunal ruled extensively on the second and third questions within its determined jurisdiction, but it did not decide the first question of island sovereignty.

This distinction remains crucial for understanding the enduring dispute. Ten years after the award, neither side has moved closer to accepting the other's interpretation. Manila asserts that international law and the arbitral decision define its maritime rights. Beijing maintains that the arbitration itself was illegitimate and cannot override China's sovereignty claims. As Chinese and Philippine ships and aircraft continue operating in the same contested spaces, what began as a legal disagreement remains one of Asia's most persistent and potentially dangerous maritime flashpoints.
