US Military Access to Philippines: No Rent, Shared Costs

The Enhanced Defense Cooperation Agreement (EDCA), signed in April 2014, serves as the central framework governing U.S. military access to sites in the Philippines without rental fees. Article 3 of the agreement explicitly forbids any rental or similar costs for the use of these facilities. Under this arrangement, U.S. forces are responsible for covering their own operational expenses while deployed to the agreed-upon locations.

The Philippine government consistently asserts its full ownership of all sites utilized under the EDCA, refuting any claims that these installations might be American-owned. Philippine authorities have repeatedly emphasized that ownership remains unequivocally with the Philippines, notably rejecting foreign-ownership claims in March 2026.

The nature of the U.S. military presence in the Philippines underwent a significant transformation after the Philippine Senate's rejection of a new treaty in 1991, leading to the closure of major permanent bases like Clark Air Base and Subic Bay Naval Base in the early 1990s. This marked a shift from the colonial-era model of large-scale, permanent bases to modern alliance agreements focusing on rotational access. Despite these changes, foundational defense treaties such as the 1951 Mutual Defense Treaty and the 1999 Visiting Forces Agreement continue to underpin the security relationship between the two nations.

In January 2016, the Philippine Supreme Court legally upheld the EDCA. The court's majority opinion accepted the agreement's status as an executive agreement, affirming its function within existing treaty commitments rather than classifying it as a commercial lease.

In 2023, the EDCA network expanded significantly under President Ferdinand Marcos Jr.'s administration, increasing the number of available locations from five to nine. These strategically chosen new sites include crucial naval and air bases in Northern Luzon and Palawan. This expansion provides tactical advantages for positioning U.S. forces, facilitating movement and supply logistics, particularly in proximity to Taiwan and the South China Sea.

In exchange for military access under the EDCA, the Philippines primarily receives infrastructure investments, with the United States proposing substantial funding for projects that mutually benefit both nations. As of February 2023, the United States had already allocated over $82 million for infrastructure investments at the original five EDCA locations. More recently, by April 2024, U.S. budget requests included an additional $128 million for 36 new projects across the expanded network of sites. The ultimate value of these investments for the Philippines will depend on their actual construction and long-term sustainability, aiming to enhance the host nation's military capabilities and overall infrastructure.
