Arrest at anti-migrant protest sparks 'two-tier policing' outcry

Police had warned they would arrest anyone covering their face at anti-migrant protests, and the man identified as identifying as a lady was arrested just an hour after that warning was issued.

Police actively escorted rival protest groups into the area where the anti-migrant demonstrators had already gathered. The groups brought in included 'stop the far right' and 'stand up to racism' organisations.

Video evidence showed multiple far-left counter-demonstrators with their faces covered at the same protest. None of them were arrested for covering their faces, despite police having just arrested the man in the burka under the same powers. The selective enforcement raised the question of why the face-covering ban appeared to apply only to one side of the demonstration.

This longstanding tolerance of masked left-wing protesters contrasted sharply with the immediate enforcement against the man at the Portsmouth protest.

The presenter argued that if face coverings are to be banned, the law should apply uniformly across all groups and all causes. The proposal encompassed burkas, niqabs, balaclavas, and surgical masks—without exception based on the wearer's political affiliation or stated reason.

GB News reporter Linda Jubilee, who has covered Gaza and left-wing protests for years, noted that police never once demanded those protesters remove their face coverings. Some of those demonstrations ended in violence, yet authorities never invoked special powers to unmask participants or make arrests for mask-wearing.

Jubilee advanced a principled reason for universal masking bans: facial recognition serves as court evidence in criminal prosecutions. If the criminal justice system relies on photographic and facial recognition, allowing any category of face covering—whether religious, medical, or tactical—undermines that evidentiary foundation. The logic applied regardless of the wearer's motivation or political cause.

The Portsmouth protest on Sunday night left police stressed throughout the week that followed. Officers appeared to be reacting in an improvised way rather than following a clear pre-set strategy, suggesting the event had caught law enforcement unprepared despite warnings.

Panelists argued that both the police and Home Secretary Shabban Mahmud were making reactive decisions rather than establishing a coherent framework first. The panel called for a consistent position set from the beginning, applied in a balanced and measured way across all circumstances. The current approach—where each side reacted to the moment—was characterized as unhelpful for the country.

The panel highlighted a contrast: masked protesters appearing at a Reform Party conference event were not arrested or targeted by police, yet the Home Secretary was pushing for arrests of people wearing masks at anti-migrant protests. This disparity illustrated what commentators called 'two-tier hypocrisy'—the law appeared to depend on which political movement was doing the protesting. The accusation was that enforcement reflected the government's political preferences rather than neutral application of the law.

The Home Secretary and other officials called the people protesting in Dover 'thuggery' when the demonstrations occurred. This rhetoric spiraled into a more heated situation and, according to panel analysis, did not help de-escalate or calm public tension.

Section 158 of the Crime and Policing Act gave police the power to demand mask removal at protests and arrest anyone who refused. The Home Secretary called for these powers to be deployed against people at anti-migrant demonstrations. Yet commentators noted that over the preceding 24 to 48 hours, other protests had seen objectively more violence, yet police did not invoke Section 158 at those events. The selective deployment raised questions about whether the law was being applied based on the content of the protest rather than the level of actual disorder.

One panelist traced the anti-migrant protests to a fundamental failure of government action. The state, he argued, has not solved the problem of a large number of dangerous foreign men in the country who commit serious crimes. When the state does not address such a problem, the public takes action themselves—which, while undesirable, becomes inevitable. The disproportionate and two-tier enforcement of the mask ban, he suggested, reflected not just hypocrisy but also fear on the part of authorities who have lost control of the issue. The protests would not be happening, in this view, if the state had fixed the underlying problem.

The direction to police created a two-tier system by design.

A measured approach would have established uniform rules in advance and applied them to all protests regardless of their political character.

Assistant Chief Constable Paul Bartholomew of Hampshire Police stated that policing protests is routine work for which officers are trained. He emphasized that specialist teams are ready to be deployed and that officers make rapid judgments designed to keep people safe while supporting the right to peaceful protest. Police framed their use of 'robust' powers as a necessary response to the minority seeking to cause violence.
